1. Introduction
These Terms of Service ("Terms") govern your access to and use of the services provided by Dear Life ("we", "us", "our"). By accessing or using our website (dearlife.com.au) or requesting/receiving our services (coaching, hypnotherapy, therapy, consultations), you agree to be bound by these Terms. If you do not agree, please do not access our services.
2. Definitions
• “Client” or “you”: an individual who registers, books, or receives services from us.
• “Services”: the coaching, hypnotherapy, timeline therapy, brainspotting, or other wellness services offered by Dear Life.
• “Booking”: a scheduled session, consultation, or therapy appointment.
• “Fees”: payments required for the Services.
3. Provision of Services
3.1 We will use reasonable skill and care to provide the Services in accordance with your booking and these Terms.
3.2 We may amend, suspend or discontinue any Service (or part thereof) at our discretion, provided we act reasonably and give notice where practicable.
4. Client Obligations
4.1 You warrant that the information you provide at booking (name, contact, date of birth, health details, etc.) is true and complete.
4.2 You agree to cooperate with us and provide any requested information or documentation necessary for the Services.
4.3 You agree not to rely on the Services as a substitute for medical or mental-health advice where such professional advice is required.
5. Booking and Payment Terms
5.1 Bookings are confirmed upon your acceptance and payment of the required Fees, as displayed at time of booking.
5.2 Fees must be paid in advance (unless otherwise agreed). All amounts are in AUD, and you are responsible for any bank or card processing fees.
5.3 If you cancel or reschedule a booking less than 24 hours before the session, the fees may be forfeited or a cancellation fee applied, unless we agree otherwise in writing.
5.4 All promotional offers, discounts and payment plans are subject to the terms and conditions specified at the time.
5.5 Payment Policy
To secure your place and begin the Dear Life Optimisation process, the following applies:

5.5.1 50% Deposit (Non-Refundable)
A 50% non-refundable deposit is required once your Client Intake Form is completed and submitted. This confirms your booking, covers pathology administration, analysis prep, and locks in your consultation window.
5.5.2 Remaining 50%
The remaining 50% balance is due before your consultation, and your full Dear Life Optimisation Report is released upon payment.
5.5.3 Why a 50% Non-Refundable Deposit?
• Your pathology forms and analysis begin immediately after intake.
• Significant time is invested before your appointment.
• Ensures committed clients and maintains the concierge-level service standard.
• Prevents late cancellations and unpaid work.
6. Intellectual Property
6.1 All materials, content, trademarks, logos and methodologies used in the provision of the Services remain the property of Dear Life and/or its licensors.
6.2 You may not reproduce, adapt, distribute or otherwise use any materials provided without our prior written consent.
7. Confidentiality & Privacy
7.1 We will maintain confidentiality of client records in accordance with our Privacy Policy and professional obligations.
7.2 You acknowledge that while your sessions are confidential, we may be required by law, regulatory body or professional association to disclose information

8. Liability
8.1 To the fullest extent permitted by law, our liability for any loss arising out of your use of the Services is limited to the amount you paid for the booking that gave rise to the claim.
8.2 We exclude liability for indirect, consequential or future losses (including loss of profit or business opportunity) to the extent permitted under the Australian Consumer Law.
8.3 Nothing in these Terms limits your rights under the Australian Consumer Law which cannot be excluded.
9. Termination
9.1 We may terminate or suspend your access to the Services at any time if:
• you breach these Terms; or
• professional/ethical obligations require us to cease providing services.
9.2 On termination, any advance payment for sessions not yet provided may be refunded at our discretion less any reasonable administrative costs
10. Changes to Terms
10.1 We may vary these Terms at any time. We will publish the updated version on our website and notify you where feasible.
10.2 Your continued use of the Services after any changes signifies your acceptance of the updated Terms.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that state/territory and the Commonwealth of Australia
